Article 1 - Definitions
  • Supplementary agreement: an agreement whereby the consumer acquires products, digital content, and/or services in connection with a distance contract.
  • Reflection period: the period within which the consumer can make use of his right of withdrawal.
  • Consumer: the natural person who is not acting for purposes related to their trade, business, craft, or professional activity.
  • Day: calendar day.
  • Digital content: data produced and supplied in digital form.
  • Long-term contract: a contract aimed at the regular supply of goods, services, and/or digital content over a certain period.
  • Durable data carrier: any means that allow the consumer or entrepreneur to store information directed to them personally.
  • Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the reflection period.
  • Entrepreneur: the natural or legal person who is a member of the Dutch Thuiswinkel Organization and offers products, digital content, and/or services to consumers remotely.
  • Distance contract: a contract concluded between the entrepreneur and the consumer.
  • Model withdrawal form: the European model withdrawal form included in Annex I of these conditions.

Article 3 - Applicability

1. These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will, before concluding the distance contract, indicate how the general terms and conditions can be viewed and that they will be sent free of charge upon request.
3. If the distance contract is concluded electronically, these general terms and conditions can be made available electronically before concluding the distance contract.
4. In case of specific product or service conditions, the consumer can always rely on the applicable provision that is most favorable to them in the event of conflicting conditions.

Article 4 - The Offer

1. If an offer has a limited period of validity, it will be explicitly stated.
2. The offer contains a complete and accurate description of the products, digital content, and/or services offered.

Article 5 - The Agreement

1. The agreement is concluded when the consumer accepts the offer and meets the associated conditions.
2. If the consumer accepts the offer electronically, the entrepreneur will confirm receipt of the acceptance electronically without delay.
3. If the agreement is concluded electronically, the entrepreneur will take appropriate measures to ensure a secure electronic environment.
4. The entrepreneur can investigate whether the consumer can fulfill their payment obligations.

Article 6 - Right of Withdrawal

1. The consumer can withdraw from a product purchase agreement within 30 days without providing reasons.
2. The reflection period starts the day after the consumer or a third party designated by the consumer (other than the carrier) receives the product.

Article 7 - Obligations of the Consumer During the Reflection Period

During the reflection period, the consumer will handle the product and its packaging with care and only unpack or use it as necessary to determine its nature, characteristics, and functioning.

Article 8 - Exercise of the Right of Withdrawal by the Consumer and Costs

1. If the consumer exercises the right of withdrawal, they must inform the entrepreneur within the reflection period using the model form for withdrawal or in another unequivocal manner.
2. The consumer must return the product within 14 days after notifying the entrepreneur.

Article 9 - Obligations of the Entrepreneur in the Event of Withdrawal

The entrepreneur will refund all payments made by the consumer, including any delivery costs, as soon as possible but within 14 days following the day the consumer notifies them of the withdrawal.

Article 10 - Exclusion of the Right of Withdrawal

The entrepreneur can exclude the right of withdrawal for certain products, but only if the entrepreneur has clearly indicated this in the offer and before concluding the agreement.

Article 11 - The Price

The prices of the offered products and/or services will not be increased during the validity period stated in the offer, except for price changes due to changes in VAT rates.

Article 12 - Performance of Agreement and Additional Guarantee

The entrepreneur ensures that the products and/or services comply with the agreement and the specifications listed in the offer.

Article 13 - Delivery and Execution

The entrepreneur will take the utmost care when receiving and executing product orders and when assessing applications for the provision of services.

Article 14 - Long-term Transactions: Duration, Termination, and Extension

The consumer can terminate a contract that has been concluded for an indefinite period with a notice period of no more than one month.

Article 15 - Payment

The amounts owed by the consumer must be paid within 14 days after the reflection period begins, or, in the absence of a reflection period, within 14 days of the conclusion of the agreement.

Article 16 - Complaints Procedure

The entrepreneur has a well-publicized complaints procedure and handles complaints according to this procedure.

Article 17 - Disputes

Contracts between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.

Article 18 - Industry Guarantee

The Dutch Thuiswinkel Organization guarantees compliance with binding advice from the Disputes Committee.

Article 19 - Additional or Deviating Provisions

Additional or deviating provisions must not be detrimental to the consumer and must be recorded in writing or in such a way that the consumer can store them in an accessible manner on a durable data carrier.

Article 20 - Amendments to the Thuiswinkel General Terms and Conditions

Changes to these terms and conditions are only effective after they have been published in the appropriate manner.
